Terms of Service
These Terms of Service (“Terms”) govern access to or use of Carspel software, websites, and related services (“Services”). By downloading Carspel, creating an account, or continuing to use the Services, you agree to these Terms.
If you use Carspel on behalf of a company or household, you represent that you have authority to bind that entity, and “you” includes that entity.
1. Operator
Carspel is developed by FundaMedia. Privacy practices are described in our Privacy Policy.
2. Eligibility & accounts
- You must provide accurate registration information and safeguard credentials.
- You are responsible for activity under your account except where unauthorized access results solely from our gross negligence.
- Notify hello@carspel.ca promptly about suspected breaches.
3. Changes
We may modify features, discontinue legacy flows, or update these Terms. We will post revised Terms with an updated effective date. Continued use after changes constitutes acceptance except where applicable law requires explicit consent for material changes affecting pricing or consumer rights.
4. License to use Carspel
Subject to compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Services for their intended household vehicle-recordkeeping purposes.
You may not reverse engineer except where statute permits, circumvent security, scrape Services at scale without permission, resell access, or misuse APIs.
5. Your content
You retain rights to fuel logs, notes, receipts, photos, and other materials you submit (“User Content”). To operate Carspel you grant us a worldwide license to host, process, encrypt in transit, back up, display within your authorized households, generate exports you request, and share content consistent with household permissions or lawful transfers (such as vehicle log transfers initiated by you).
You represent that you have rights to upload User Content and that it complies with law. Do not upload unlawful, infringing, or malicious material.
6. Acceptable use
- No harassment, hacking attempts, malware distribution, or attempts to bypass authorization models.
- No use of recall/regulatory lookups or exports to mislead buyers or regulators.
- No harvesting personal information of other users beyond household-permitted visibility.
7. Plans, billing, trials
- Certain features may require paid subscriptions or trials managed via mobile storefronts (for example Google Play) or, when activated, web billing via processors such as Stripe.
- Pricing, taxes, renewal cadence, refund eligibility, and cancellation pathways follow the relevant storefront or checkout provider policies unless otherwise communicated inside the product.
- If entitlement records diverge temporarily between devices and backend systems, the authoritative subscription status reflected after sync controls access.
8. Third-party services
Maps, diagnostics vendors (such as Sentry), authentication/database hosts (such as Supabase), regulatory APIs, or AI tooling invoked through optional workflows operate under their respective terms. Your use constitutes acceptance of those integrated dependencies where applicable.
9. Availability & beta features
We strive for reliability but do not guarantee uninterrupted operation. Features labeled preview/beta may change or be withdrawn.
10. Disclaimer
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind whether express or implied, including merchantability, fitness for a particular purpose, accuracy of mileage calculations, completeness of recalls information returned by external regulators, or fitness for commercial accounting/tax filings.
You alone decide whether exported records satisfy regulatory or taxation obligations.
11. Limitation of liability
To the extent permitted by applicable law, neither Carspel, FundaMedia, nor their suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits/data/goodwill, arising from use of the Services.
Aggregate liability for claims relating to the Services will not exceed the greater of (a) amounts you paid us for the Services during the twelve months before the claim or (b) fifty Canadian dollars (CAD $50), except where statute forbids such caps.
12. Indemnity
You will defend and indemnify Carspel and FundaMedia against third-party claims arising from your User Content, misuse of the Services, or breach of these Terms, subject to procedures permitted under governing law.
13. Termination
You may stop using Carspel anytime and request account deletion consistent with our Privacy Policy. We may suspend or terminate access for violations, risk to users, or legal requirements.
14. Governing law & disputes
These Terms are governed by the laws of Alberta, Canada and applicable federal laws of Canada, excluding conflict-of-law rules that would refer another jurisdiction.
Consumers residing in jurisdictions that mandate exclusive local remedies may have additional rights—nothing herein limits non-waivable protections.
15. Miscellaneous
- Entire agreement. These Terms and referenced policies constitute the entire agreement regarding the Services.
- Severability. Invalid provisions will be modified minimally to reflect intent.
- Assignment. You may not assign these Terms without consent; we may assign them in connection with a merger or sale.
- No waiver. Failure to enforce a provision is not a waiver.
